1. Acceptance of Terms

By creating an account or using GarudAgniAI.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Acceptable Use Policy, and Cookie Policy (collectively, the "Agreement"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration & Security

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately of any unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.
• One person or legal entity may not maintain more than one free account.

4. Description of the Service

GarudAgniAI.com provides an AI-powered interview coaching platform that includes:

• Mock Interviews: AI-generated practice interviews with real-time transcription and evaluation.
• Live Interview Assistance: Real-time coaching during actual interviews (subject to ethical use guidelines).
• Communication Coaching: AI-powered feedback on communication skills.
• Resume Analysis: AI-driven resume review and optimization suggestions.
• Institutional Tools: Bulk interview management for educational institutions.

5. Subscriptions & Billing

5.1 Plans

The Service offers Free, Plus, and Enterprise tiers. Features and limits vary by plan as described on our pricing page.

5.2 Payment

• Paid subscriptions are billed in advance on a monthly or annual basis.
• All fees are non-refundable except as required by applicable law or as stated in Section 5.4.
• We reserve the right to change pricing with 30 days' prior notice.

5.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can cancel at any time from your account settings.

5.4 Refund Policy

If you are unsatisfied with the Service, you may request a refund within 7 days of your initial purchase. Refunds are not available for renewal charges. Contact legal@interviewai.coach to request a refund.

6. Intellectual Property

6.1 Our Property

The Service, including all software, algorithms, AI models, designs, text, graphics, and trademarks, is owned by GarudAgniAI.com and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

6.2 Your Content

You retain ownership of content you upload (resumes, recordings). By uploading content, you grant us a limited, non-exclusive license to process it for Service delivery. We will not use your content for training AI models without explicit opt-in consent.

7. Acceptable Use

You agree to comply with our Acceptable Use Policy. Without limitation, you must not:

• Use the Service to cheat, deceive, or misrepresent your qualifications in actual job interviews.
• Record other parties without their consent using our tools.
• Share, resell, or redistribute your account access.
• Attempt to reverse-engineer, scrape, or extract AI model weights or training data.
• Use the Service for any unlawful purpose.

8. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate interview questions, evaluations, and coaching feedback. AI-generated content is provided for educational and practice purposes only. GarudAgniAI.com makes no guarantee that AI-generated content is accurate, complete, or suitable for any specific purpose. You should independently verify all AI-generated advice before acting on it.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• GarudAgniAI.com SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
• WE DO NOT GUARANTEE THAT THE SERVICE WILL RESULT IN JOB OFFERS, INTERVIEW SUCCESS, OR ANY PARTICULAR OUTCOME.

10. Indemnification

You agree to indemnify and hold harmless GarudAgniAI.com, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

• You may terminate your account at any time through account settings or by contacting support.
• We may suspend or terminate your account for Terms violations with or without notice.
• Upon termination, your right to use the Service ceases immediately.
• We will retain your data as described in our Privacy Policy and delete it upon request (subject to legal obligations).

12. Dispute Resolution

We encourage resolving disputes informally first by contacting us at legal@interviewai.coach. If a dispute cannot be resolved informally:

• Users in India: Disputes shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Bangalore, India.
• Users in the EU / EEA / UK: You may bring proceedings in the courts of your country of residence or use available online dispute resolution mechanisms (EU ODR platform at ec.europa.eu/consumers/odr). Nothing in these Terms limits your right to approach your local courts for mandatory consumer protection matters.
• Users in the United States: Disputes shall be resolved through binding individual arbitration under the AAA Consumer Arbitration Rules. Class actions and class arbitrations are waived to the extent permitted by law. California users retain the right to bring individual claims in small claims court.
• Users in Australia: You may seek resolution through the Australian Competition and Consumer Commission (ACCC) or relevant state consumer protection body. Nothing limits your rights under the Australian Consumer Law.
• All other users: Disputes shall be resolved by binding arbitration under UNCITRAL Arbitration Rules with the seat in Bangalore, India, or in the courts of your country of residence where mandatory law requires.

Each party bears its own costs unless otherwise required by law.

13. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles, except where mandatory local law applies:

• EU / EEA users: Your rights under EU consumer protection laws, the General Data Protection Regulation (GDPR), and the Digital Services Act (DSA) are unaffected by these Terms.
• UK users: Your rights under the UK Consumer Rights Act 2015, the UK GDPR, and related legislation are unaffected.
• California users: Your rights under the California Consumer Privacy Act (CCPA) and California consumer protection statutes are unaffected.
• Australian users: Your rights under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010) are unaffected, including statutory guarantees that cannot be excluded.
• Canadian users: Your rights under PIPEDA (or applicable provincial privacy legislation) and consumer protection statutes are unaffected.
• Brazilian users: Your rights under the Lei Geral de Proteção de Dados (LGPD) are unaffected.

14. Regional Regulatory Compliance

GarudAgniAI.com is committed to complying with applicable laws in all jurisdictions where the Service is used. This includes, but is not limited to:

• GDPR (EU/EEA): We act as a data controller and implement all required safeguards. See our Privacy Policy for details.
• UK GDPR: We comply with the UK's retained data protection framework post-Brexit.
• CCPA / CPRA (California): We do not sell or share personal information for cross-context behavioral advertising. See our Privacy Policy for your California rights.
• LGPD (Brazil): We process Brazilian user data in accordance with LGPD requirements.
• PIPEDA (Canada): We follow Canadian privacy principles for all Canadian users.
• IT Act & DPDP Act (India): We comply with India's Information Technology Act 2000 and the Digital Personal Data Protection Act 2023.

15. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days in advance. Continued use after the effective date constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, Acceptable Use Policy, and Cookie Policy, constitute the entire agreement between you and GarudAgniAI.com regarding the Service.
